(OTL) – A man is seeking at least 3 million dollars in damages after he allegedly forgot his cellphone at McDonald’s and racy pictures of his wife’s rear ended up on the internet. The reason he sees McDonald’s as responsible for the infraction is because he called the restaurant and asked if they had found his cell phone. An employee that he spoke with said that they had found it and would hang onto it until he returned to pick it up. It was after that that the racy pictures showed up on the internet.
The racy photos of the man’s wife were on his cellphone, which is considered private property and tampering with it can be considered an offense depending on the situation. In this case, because the McDonald’s employee had it in his/her possession and the photos ended up online afterwards, they might be liable. His phone was stolen at a McDonald’s restaurant in Arkansas. Because the McDonlald’s employee said that he/she had the phone, the man is suing McDonald’s Corp. due to the embarrassment this has caused him and his wife, and undue suffering that caused them to have to move to a new house.
Phillip Sherman, the man whose phone was stolen has vowed that he will never leave his phone anywhere again after the hardship this has caused his wife and him.
Thus far, no one from McDonald’s has released a statement about the lawsuit. It is due to enter court sometime in the next couple of months for review.
