A judge ruled she will not face any further charges.

Circuit Judge J. Rodgers Padgett stated that Debra Lafave did violate her probation by talking with the 17-year-old about sex, but he stated that she was not “willful nor substantial” in the way she talked.

The 27-year-old Lafave talked with a 17-year-old teenage waitress at a restaurant about her personal life and other matters.

Lafave is serving three years’ house arrest and seven years’ probation after pleading guilty to having sex with a 14-year-old boy in a classroom as well as in her home in June 2004.

She smiled and pumped her fist after the judge ruled she would not be punished further. Her attorney, John Fitzgibbons, stated that she was being targeted.

The department stated they will continue to monitor Lafave.
