Will Chad Kroeger serve time for his DUI?

Kroeger's lawyer, Marvin Stern, argued a police officer conducted an unlawful search of his client's Ferrari after detecting the smell of alcohol on the rocker's breath.Nickelback front man Chad Kroeger has been convicted of driving under the influence (DUI).

Kroeger, real name Chad Turton, was pulled over for speeding on June 22nd, 2006. He faces charges of impaired driving and driving with a blood alcohol level over .08 - the legal limit.

Kroeger’s lawyer, Marvin Stern, argued a police officer conducted an unlawful search of his client’s Ferrari after detecting the smell of alcohol on the rocker’s breath. Stern insisted that the field breath test results should be thrown out of court, but Judge Peder Gulbrandsen disagreed. Kroeger’s case was adjourned until March 12th.

While Kroeger was not present at the hearing, Provincial Court Judge Peder Gulbransen said he would like the rocker to show for the sentencing scheduled for May 1.

Kroeger’s lawyer said he is current in Europe working on a new project.

In a recent interview with Playboy, the Canadian rocker admitted to previous brushes with the law, saying that “incarceration’s no fun.”

Reportedly, Kroeger will either have to pay a fine or will have his driver’s license suspended.

his lawyers plan to appeal the decision.
